2. Eligibility & Age

You must be at least 18 years old to create an account and use the Services.

If you are between 13–17 years old, your account must be created and managed by a parent or legal guardian.

By registering, you represent that you meet these age requirements and have the legal authority to enter into this agreement.

3. Account Registration & Security

To access certain features, you must register by providing a valid email address and creating a password.

You agree to:

• Provide accurate, complete information;
• Keep your credentials confidential;
• Notify us immediately of any unauthorized use of your account.

You are solely responsible for all activity under your account.

4. License & Intellectual Property Rights

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use.

All content and materials in the Services—designs, text, graphics, images, video, software, code, and all related intellectual property rights—are owned by PocDoc or our licensors and are protected by U.S. and international copyright, trademark, and other laws.

No rights or title to that content are transferred to you. You may not reproduce, modify, distribute, create derivative works of, publicly display, or otherwise exploit any part of the Services without our prior written permission.

5. User Content & Data

Your Data

You retain ownership of any health metrics, documents, or other personal data (“User Content”) you upload or import.

License to PocDoc

While your account is active, you grant us a worldwide, royalty-free license to use, host, reproduce, and display your User Content solely to provide and improve the Services.

Sharing

We will never share your personally identifiable User Content with third parties without your explicit consent, except as described in our Privacy Policy.

6. Communication

We send you communications essential to providing the Services (e.g., account verification, security alerts, password resets) regardless of your marketing preferences.

For optional communications (e.g., newsletters, feature announcements), you can opt out at any time via the unsubscribe link or your account settings.

Changes to your communication preferences take effect within 24 hours—never more than 10 days.

7. Third-Party Data & Integrations

By connecting third-party services, you authorize us to retrieve and store data those services send. We do not control what data they share.

You may customize or revoke any integration in your account settings at any time.

We cannot guarantee the accuracy, completeness, or legality of third-party data. We use reasonable skill to process and display it, but you should always verify any critical information with a qualified professional.

8. Medical Advice Disclaimer

The Services organize and retrieve information—you alone are responsible for medical decisions.

We may cite public health guidelines but that is for convenience only, not professional advice.

Always consult a qualified healthcare professional before taking any actions based on data or recommendations in the App.

9. Subscriptions & Payment

PocDoc offers both free and paid subscription plans (“Premium”).

9.1 Free Trial

Free trials (if offered) begin upon signup and convert to paid subscriptions at trial’s end unless canceled at least 24 hours beforehand.

9.2 Automatic Renewal

Paid subscriptions renew automatically at the then-current rate unless canceled prior to renewal.

9.3 Cancellation & Refunds

You may cancel at any time via your account settings or by emailing support@pocdoc.health.

Cancellations take effect at the end of the current billing period; no prorated refunds for unused time.

Except as required by law, all fees are non-refundable.

10. Prohibited Conduct

You agree not to:

• Violate any applicable laws or regulations;
• Reverse-engineer, decompile, or disrupt the Services;
• Impersonate others or infringe third-party rights;
• Upload malware or harmful code.

11. Commitments & Warranty

We warrant that we will provide the Services with reasonable skill and care. Beyond this, all other warranties—whether express, implied, or statutory, including fitness for a particular purpose—are disclaimed to the fullest extent permitted by law.

12. Limitation of Liability & Indemnification

Liability Cap

Notwithstanding anything to the contrary in these Terms or applicable law, in no event will PocDoc’s total aggregate liability arising out of or related to these Terms or the Services exceed the total amount of fees you have paid to PocDoc for the Service in the twelve (12) months immediately preceding the claim.

Exclusion of Damages

To the maximum extent permitted by law, PocDoc and its affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages (including lost profits, revenue or data), even if we have been advised of the possibility of such damages.

Indemnification

You agree to defend, indemnify, and hold harmless PocDoc and its officers, directors, employees, and agents from any claims, losses, liabilities, costs or expenses (including reasonable attorneys’ fees) arising out of or relating to your breach of these Terms or your use of the Services.

13. Termination & Disabling Access

We may suspend or terminate your access at our discretion, without notice, if you breach these Terms.

If we terminate your access for cause, we will refund any prepaid fees for services not yet rendered, on a pro-rated basis.

Upon termination, your license ends and you must cease all use of the Services.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of California, USA, excluding its rules of conflict of law.

Any dispute arising under these Terms must be resolved exclusively in the state or federal courts located in San Francisco County, California.

15. Changes to These Terms

We may modify these Terms at any time by posting the updated version at https://pocdoc.health/terms. Continued use after changes constitutes your acceptance.

17. Severability & Entire Agreement

If any provision of these Terms is held invalid, the remainder will continue in full force. These Terms (and our Privacy Policy) constitute the entire agreement between you and PocDoc regarding the Services.
